Uncontested Divorce

An uncontested divorce is where the parties have no issues unresolved. Custody, support and a division of property have all been agreed upon. Quite often the parties at that point will sign a Property Settlement Agreement to be incorporated into the Final Decree of Divorce.

Uncontested divorces are generally filed on the one-year and six-month no-fault grounds depending on the circumstances. These divorces can be processed quickly. All issues must be resolved; the parties must have lived apart for the required period of time; and, the spouse is willing to cooperate.
